Terms and Conditions for the 'Machines Go Cashless' Campaign

Effective Date: 1st June 2024

Welcome to the "Machines Go Cashless" campaign, an initiative to promote the DuitNow Cashless system for self-service kiosks. By participating in this campaign, you agree to the following terms and conditions:

1. Campaign Overview

  • Objective: To enable self-service kiosks to accept DuitNow QR payments, promoting a cashless payment system in rural areas.
  • Duration: The campaign will run for six months, commencing on June 1, 2024, and concluding on November 30, 2024.
  • Locations: The campaign targets East Coast (Kelantan, Terengganu, and Pahang), Sabah, and Sarawak.

2. Eligibility

  • Participants: This campaign is open to owners and operators of self-service laundromats, and other eligible self-service devices.
  • Commitment: Participating merchants must commit to using the DuitNow QR system for a minimum period of three years from the campaign's completion date.
  • Approval: MyPayment Gateway reserves the right to approve or reject any participating merchant based on eligibility criteria.

3. Incentives and Subsidy

  • Subsidy Usage: The subsidy provided by PayNet will be used to cover the three-year subscription fee for the DuitNow QR system for participating merchants.
  • Benefits:
    • 1. Free three-year subscription to the DuitNow QR system.
    • 2. Increased customer convenience and potential for higher transaction volumes.
    • 3. Enhanced visibility and branding through participation in a high-profile cashless initiative.

4. Participation Requirements

  • Limited Spots: Only 10 outlets will be selected in each stage of the campaign, covering the regions of Kelantan, Terengganu, Pahang, Sabah, and Sarawak. Early sign-up is encouraged to secure a spot.
  • Transaction Volume: Merchants are encouraged to achieve a minimum monthly average of 36 transactions per device and RM200 transaction value per device to maximize the benefits of the campaign.
  • Cashless Payment Usage: Merchants must achieve an overall cashless penetration of 60%-80% during the three-year commitment period.
  • Active Usage: Self-service kiosks must remain active with DuitNow QR transactions for the duration of the three-year commitment period.
  • Branding and Placement: DuitNow QR branding must be prominently displayed on all enabled self-service kiosks, following the specifications and guidelines provided by PayNet.

5. Approval and Monitoring

  • Location Approval: All proposed self-service kiosk locations must be approved by PayNet. The campaign focuses on East Malaysia and the East Coast regions.
  • Merchant Approval: MyPayment Gateway reserves the right to approve or reject merchants based on eligibility and suitability for the campaign.
  • Reporting: Participants must provide regular reports on transaction volumes and values to MyPayment Gateway and PayNet.

6. Termination and Compliance

  • Non-Compliance: Failure to comply with the terms and conditions of this campaign may result in the termination of participation and forfeiture of any subsidies.
  • Termination by MyPayment Gateway: MyPayment Gateway reserves the right to terminate this agreement if the Company fails to fulfill its obligations or if there is a significant change in circumstances that materially affects the execution of the works, provided that thirty (30) days' prior written notice is given to the Company.

7. Confidentiality

  • Confidential Information: Participants must keep all information regarding the campaign confidential and not disclose it to any third party without prior written consent from MyPayment Gateway or PayNet.

8. Data Protection

  • Compliance: Participants must comply with all applicable data protection laws and regulations, ensuring the secure handling of customer data.

9. Dispute Resolution

  • Negotiation and Mediation: Any disputes arising from this campaign will be resolved through negotiation and mediation at the Asian International Arbitration Centre in Kuala Lumpur.

10. Governing Law

  • Jurisdiction: This campaign and its terms and conditions are governed by the laws of Malaysia, and any disputes will be subject to the jurisdiction of the Malaysian courts.

11. Amendments

  • Right to Amend: MyPayment Gateway reserves the right to change, amend, or modify these terms and conditions at any time without prior notice. Any changes will be communicated to participants through [communication method, e.g., email, website update]
